July Update: The DC Council passed the FY27 BSA on July 7, 2026 with BEPS dates as noted below.
The District’s proposed FY27 Budget Support Act (BSA) included a one year delay for the start of future BEPS cycles, but notably the BSA did not propose any delays for Cycle 1 requirements. What this means for buildings in this current cycle:
- Buildings not in compliance with BEPS Cycle 1 must demonstrate compliance with their selected pathway by December 31, 2026. This includes all buildings over 50,000 square feet that were not in compliance with BEPS at the start of the cycle.
- All reporting requirements for 2027 remain in place, including submission of Completed Actions Report and third-party verified benchmarking data by May 1, 2027.
If DC Council votes to pass the proposed delays to future BEPS cycles, the timeline would be adjusted as follows:
- Buildings 25,000-50,000 square feet will be subject to BEPS starting in 2029
- Buildings 10,000-25,000 square feet will be subject to BEPS starting in 2035
- BEPS Cycle 2 for Buildings over 50,000 square feet will start in 2029
This is pending the DC Council vote, which is expected to occur in June.
