The Alternative Compliance Pathway (ACP) allows for methods for compliance outside of the three Principal Pathways (Performance Pathway, Standard Target Pathway, or Prescriptive Pathway) that achieve the equivalent or greater energy savings than the Principal Pathways.

One of those options includes deep energy retrofits—for building owners that have targeted a higher energy savings goal than required under a Principal Pathway—who wish to have certainty around long-term compliance with BEPS.

The Extended Deep Energy Retrofits (EDER) ACP Option was designed for building owners who want to achieve deeper energy savings but want more time to do it. In exchange for additional time, owners must save more energy over the course of several compliance cycles. To qualify for this pathway, buildings must be categorized as one of the following: 1) affordable housing buildings (referred to as “Affordable Multifamily Housing”), 2) rent-controlled buildings seeking to avoid a Capital Improvement (CI) petition for the purpose of meeting the energy performance requirements of a Compliance Cycle, 3) College/University/Hospital campuses (referred to as “Campuses”), or 4) for Cycle 1, buildings that are under financial distress due to the COVID-19 PHE.

Using your baseline Site EUI, which is an average of your building’s CY2018 and CY2019 reported Site EUI, decrease your Site EUI by

  • 30-40% for a 2-Cycle EDER
  • 45-60% for a 3-Cycle EDER

Benchmarking Report Due

A completed District Benchmarking Benchmark Results and Compliance Report is due for buildings ≥25,000 sq. ft. for calendar year 2021.

April 1 2023

Submit Pathway Selection and an EDER Proposed Milestone Plan

Deadline to submit the Pathway Selection Form to DOEE for approval by telling them which Pathway you’ve selected. Include a proposal for this ACP Pathway option that includes an EDER Proposed Milestone Plan.

Benchmarking Report Due

A completed District Benchmark Results and Compliance Benchmarking Report is due for buildings ≥25,000 sq. ft. for calendar year 2022.

Third-Party Verified Benchmarking Report Due

A completed, third-party verified District Benchmark Results and Compliance Benchmarking Report is due for buildings ≥25,000 sq. ft. for calendar year 2023.

Benchmarking Report Due

A completed District Benchmark Results and Compliance Benchmarking Report is due for buildings ≥10,000 sq. ft. for calendar year 2024.

Benchmarking Report Due

A completed District Benchmark Results and Compliance Benchmarking Report is due for buildings ≥10,000 sq. ft. for calendar year 2025.

December 31 2026

This is the end of the BEPS 1 Compliance Cycle.

End of Future BEPS Cycle 2 or 3. 

 

During this time, your building’s energy performance will be evaluated to confirm that it meets its minimum final reduction requirements.
